The petitioner complains that Spanish public administrations are infringing Directive 1999/70/EC of the Council of 28 June 1999 concerning the framework agreement on fixed-term work concluded by ETUC, UNICE and CEEP, by hiring interim staff who are at a disadvantage compared with other public servants. The petitioner points out that the legislation in question has been repeatedly and constantly infringed by the Spanish Government and the various regional governments in that no competitions were organised to fill vacant posts for years, and when competitions were finally convened, only a very small number of posts were advertised in relation to the actual number of posts vacant, with temporary staff, who had filled such posts for years, not permitted to sit.
