The petitioner refers to a recent amendment to the Italian Highway Code prohibiting residents of Italy (those who have been there for more than 60 days) from driving vehicles registered in other Member States (with the exception of those that are hired, leased or loaned). According to the petitioner, the relevant law stipulates that, where the new rule is infringed, not only the offender may be fined but the vehicle and the vehicle documents may be confiscated, compelling the owner to jump through the hoops of Italian bureaucracy. The petitioner asks the European Institutions to adopt a position on the compatibility of the rules in question with the internal market, which he claims constitute direct or indirect discrimination in the field of the free movement of goods and persons.
