The petitioner complains that the public authorities in Spain are in breach of Council Directive 1999/70/EC of 28 June 1999 on the framework agreement on fixed-term work concluded by the ETUC, UNICE and CEEP, and of the European Parliament resolution of 31 May 2018 on the abusive use of fixed-term contracts, by seriously undermining the working conditions of court officials. The petitioner points out that the Spanish authorities are repeatedly and constantly violating this legislative act. The petitioner calls for Directive 1999/70/EC to be correctly transposed as regards effective and dissuasive mechanisms penalising the abusive use of fixed-term contracts for interim public officials working for the ‘Administración de Justicia’ [Judiciary], the conversion of these fixed-term contracts into permanent ones being the only option that complies with Directive 1999/70/EC. He also calls for the selection processes convened for the general legal and administration sections of the ‘Administración de Justicia’ to be cancelled until the provisions of the aforementioned Directive concerning penalties for abuse of fixed-term contracts are correctly transposed.
