The petitioner worked as an officer in the Polish customs service since 1993 and was responsible for customs control. He is one of many customs officers who were dismissed in 2017 when their employment contracts were not extended, i.e. they were not offered further employment, after the legal status of the customs services was changed. They became integrated into the structure of the National Revenue Administration under the name Customs and Revenue Services. According to the petitioner, he was not offered any further work due to his membership of the ‘Celnicy PL’ trade union and his active involvement in custom officers’ protests against the changes to employment procedures. Furthermore, the petitioner also calls into question his dismissal from duty which, on account of his specific legal status, excludes him from judicial protection, which he considers not only to be contrary to Polish law, but also to the EU Charter of Fundamental Rights.
