On behalf of the Citizens’ Anti-Crisis Team (Not Through the City), on a project to build an eastern section of the Warsaw bypass

The petitioner, on behalf of the Citizens’ Anti-Crisis Team (Not Through the City), alleges a violation of the right to effective legal remedy and to access to an impartial court, namely the refusal of a second-degree national administrative body to examine the residents’ appeals against a decision on the granting of environmental permits for a project, which was made immediately enforceable. It concerns the construction of the eastern section of the Warsaw City bypass by an investor, namely the General Directorate for National Roads and Motorways (official abbreviation GDDKiA). The chosen ‘green’ construction option could, unlike the original ‘red’ option, cause irreversible environmental damage Moreover, the inhabitants of the towns and settlements through which it is to run have not given their consent to this variant. A sudden change in the design of the motorway will have an impact on the district’s spatial order, does not correspond to long-term development plans and, what is more, will lead to the destruction of a valuable natural forest area called ‘Milowy Las’.
