Regarding discrimination based on nationality in connection with tax concessions for a first home in Italy

The petitioner, a Spanish national resident in Belgium, complains that he is unable to benefit from Italian legal provisions regarding a reduction in stamp duty for Italian expatriates seeking to purchase a ‘first home’ in Italy. He argues that this is a clear case of discrimination, given that he and his partner, who already share a family home in Belgium, are now seeking to purchase a house in Italy. While his partner is entitled to the preferential rate of stamp duty, he himself is not and is required to pay the full amount.
