On the alleged infringement of EU environmental law due to the construction of an expressway within a Natura 2000 site

The petitioner and other inhabitants of a commune located in the Bobrza river valley provide information on a possible infringement of the rules governing the authorisation procedure regarding the construction of the S-74 expressway running through a Natura 2000 site. The environmental permit for the project was drafted on the basis of an environmental impact report that included six different route options. Ultimately, due to public pressure, the Regional Director for Environmental Protection selected an option that runs through the Bobrza river protected area, as well through the habitats of protected animal and bird species. Furthermore, the petitioners claim that the project may degrade the environment and result in an increase in noise and exhaust emission levels.
