The petitioner claims that Article 4, paragraph 2.b of Law 4387/2016 on the reform of the pension insurance system constitutes an obvious violation of the principles of equality and proportionality and the principle of 'pro rata temporis'. He alleges that such a provision is discriminatory and therefore breaches EU law, in particular:- Article 157 TFEU on the principle of equal pay for male and female workers for equal work or work of equal value, and- Council Directive 76/207/EEC on the implementation of the principle of equal treatment for men and women as regards access to employment, vocational training and promotion, and working conditions.The petitioner was insured with the Department of Pensions for Civil Engineers and Contractors of Public Works (TSMEDE) as a freelance worker, and filed for retirement after the publication of Law 4387/2016 of 12.05.2016 and before 31.12.2016. He claims that his pension is significantly smaller than that of his colleagues, who filed for retirement before the publication of the new law, and who worked under the same conditions, paid the same pension contributions and had the same number of pensionable years and acquired rights.
