The petitioner is concerned that the draft Withdrawal Agreement will not fully cover the entire spectrum of rights that all EU citizens and family members presently enjoy in connection with residence, work and equal treatment under EU law. In particular, he argues, this concerns three categories of persons: i) family members of EU citizens who have returned home after having resided in another Member State, namely, both those who have returned home before Brexit, and those who will return home after Brexit (CJUE Case C-370/90 Surinder Singh); ii) primary carers of Union citizens having a right of residence in the EU citizens’ home country (CJUE Case C-34/09 Ruiz Zambrano); and iii) British citizens who are currently residing in an EU27 Member State and wish to preserve their rights to continuous free movement. He also states that the Withdrawal Agreement should, inter alia, enshrine UK commitments on comprehensive sickness insurance and worker status, preserve all appeal rights, maintain continued access to EU assistance services (SOLVIT and YEA), require the issuance of public compliance reports during the transitional period, and maintain adequate safeguards on the use of public policy and public security restrictions.
