On behalf of FBLS NET, on public funding that will allegedly create unfair competition in the transportation of cross-border workers

The petitioner accuses the Luxembourg authorities of having set up a public coach service for the transportation of cross-border workers, for which the transport providers combined are receiving compensation in excess of the costs created by the resulting demands. According to the petitioner, these transport providers are being allowed to use Luxembourg public funds to finance their business activities, namely providing transport in France. The petitioner refers to the ruling on the Altmark case, as well as Articles 106 and 107 of the TFEU, in which this practice is called into question.
