On behalf of the ‘Associacion Victimes Franquisme’, on impunity for crimes committed during the Franco dictatorship in Spain

The petitioner reports that the victims of crimes committed during the Franco dictatorship and their families are being denied their right to an effective remedy by the government and judicial authorities in Spain. The petitioner contends that, as stated in the Nagy Report on the situation of fundamental rights in the European Union in 2015, the Member States must cooperate with national or international judicial investigations attempting to clarify responsibilities for crimes against humanity committed in the Union by totalitarian regimes, and endeavouring to ascertain the truth and secure justice and redress for the victims thereof. The petitioner also reports an infringement of Article 47 of the Charter of Fundamental Rights of the European Union and of the Framework Decision 2008/913/JHA, which is not consistent with the Community acquis as regards the care and attention paid to victims of crime.
