The petitioners claim that there is a higher risk of accident owing to excessive driver fatigue as a result of high temperatures in the cab of heavy goods vehicles. They further claim that this is contrary to Regulation (EC) 561/2006, as the driver’s cab can no longer be said to offer ‘suitable sleeping facilities’ within the meaning of that provision. They therefore call for a mandatory requirement for trucks in Germany and the EU to be equipped with a parking air conditioning system.
