The petitioner is of the view that the Regulation (EU) No 1215/2012 contains a legal loophole as regards the provisions determining the place of jurisdiction, and that this is contrary to the otherwise high standards of EU consumer protection. The petitioner is of the view that the decision on territorial jurisdiction should always favour the consumer, and not a business entity. According to the petitioner, this is not often the case under the current legal framework. The petitioner refers to a 2017 decision of the German Supreme Court, which in his view presents a more consumer-friendly interpretation of the relevant provisions of the Regulation and which he believes ought to be uniformly applied across the EU. The petitioner explains that his views are based on a recent dispute he had with an Austrian law firm, which secured jurisdiction in an Austrian court over a dispute of an unpaid legal fees, even though the petitioner was based in Germany throughout the provision of the services.
