The petitioner alleges that Cyprus breaches Directive 2004/38/EC on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States, by denying his wife, a Turkish citizen resident in Germany, her right to enter the country without a visa. The petitioner claims that his wife cannot even book a flight to Cyprus, due to the visa requirement for all Turkish citizens imposed by Cyprus on the airlines. The petitioner calls for the free movement directive to be upheld, and questions in this regard any possible interpretation made by Cyprus of Decision No 565/2014/EU introducing a simplified regime for the control of persons at the external borders based on the unilateral recognition by Bulgaria, Croatia, Cyprus and Romania of certain documents as equivalent to their national visas.
