The petitioner, a former employee of the European Parliament, is unable to transfer her pension contribution from the EU institutions’ scheme to any private fund in the Czech Republic due to a conflict between the provisions of the Staff Regulations and the Czech law on supplementary pension savings. According to the petitioner, the Staff Regulations allow for the transfer of savings to a private fund if, among others, the capital is not repaid, whereas the Czech law guarantees the possibility for clients of private funds to receive one-time lump-sum reimbursements. Consequently, the petitioner argues, none of the Czech private funds can comply with the requirements of the Staff Regulations and all pension transfers are blocked. The European Commission advised the petitioner to use a private fund in another Member State, but she points out that this would increase her administrative costs, subject her to taxation in another Member State and deprive her of the possibility to benefit from subventions and tax exemptions in the Czech Republic. The petitioner considers that the current rules are discriminatory and in breach of Articles 3(2) TEU, Article 21 and 48 TFEU.
