On the implementation of Directive 2005/36/EC on the recognition of professional qualifications

The petitioner, established in Austria as an orthopaedic and trauma surgeon, is planning to relocate to Germany and has accordingly applied to the relevant regional medical association for recognition of his sub-specialisations. His application was rejected on the ground that they are not professional qualifications within the meaning of Directive 2005/36/EC but were acquired through further training. According to the petitioner, this specialised training is not necessary for access to the profession but, in certain cases, for insurance purposes. He is accordingly seeking clarification on whether Directive 2005/36/EC on the recognition of professional qualifications includes or should include specialist training necessary for insurance purposes.
