The petitioner complains that Italy has failed to comply with the obligation to adequately remunerate doctors who began to attend specialisation courses during the period 1982-1991, as provided for in Article 13 of Directive No 82/76/EEC on the training of specialists and courses for the attainment of the relevant diplomas. In particular, he complains about the cumbersome nature of the Italian justice system, which tends to deny or delay compensation to applicants. He invokes, in favour of his profession, the so-called ‘vertical’ direct effects of the rules contained in the Directives in question, which were not implemented in good time, with the option for individual citizens to assert their rights before the national court in accordance with the established case-law of the Court of Justice of the European Union. However, the petitioner does not specify into which of the two categories of doctors who undertook specialisation training his case falls.
