The petitioner claims that the Departmental Council of the Tarn (France) infringed the EU legislation and abused EU subventions.The concerned decision delegates the Public Service of the fibre optic broadband in the Tarn Department. This decision was made on 18 May 2018, without the preliminary opinion of the Consultative Committee of the Local Public Services (CCSPL-Commission Consultative des Services Publics Locaux). According to the research of the petitioner, this CCSPL might even not been established. The decision of delegation of the Public Service was made on a long-term basis (+ 25 years) and accounts for 400 million EUR. Such a project and decision should, according to the petitioner, be regularly monitored by the CCSPL, as stipulated by EU legislation.Regarding the EU subventions, the petitioner states that the Tarn Department is mentioned as the manager of the Public Initiative Network (Réseau Initiative Public). He confirms that this is a condition for receiving financial contributions of the partners involved (including the EU). Allocating post factum the exploitation to a private entity is against the framework in place. As a result, the private entity will eventually benefit from the subventions, and not the community as a whole.
