The petitioner claims that the dress code rules in hotels, in particular in Spain, but in general in the EU, mostly relate to men, while these rules rarely address women. The petitioner targets mainly the dress code rules in the restaurant areas. The petitioner claims that such a differentiation between men and women is an infringement of Directive 2004/113/EEC of the Council of 13 December 2004 implementing the principle of equal treatment between men and women in the access to and supply of goods and services, which bans any form of direct or indirect discrimination based on sex. He allegedly was refused access to a restaurant wearing shorts, while a woman behind him, wearing shorter shorts, was allowed in the restaurant. The petitioner further adds a detailed study in that respect of the hotels promoted by a charter operator on Fuerteventura.
