On a transposition by Bulgaria of Directive 2004/38/EC on the right of citizens of the Union and their family members to move and reside freely within the territory of the Member States

The petitioner claims that Directive 2004/38/EC has not been transposed correctly in Bulgaria. The petitioner makes a reference to Article 10 of Directive 2004/38/EC requesting presentation of a document attesting the existence of a family relationship or of a registered partnership in order to get a residence card in the EU Member State. According to the petitioner, the Bulgarian Migration Directorate requests a specific document as a proof of “durable partnership” verifying marriage or cohabitation certified by an official seal of another EU Member State. In view of the petitioner, this constitutes improper implementation of EU law.
