Lūgumraksta iesniedzējai ir bērns. Viņa, tāpat kā pats bērns un bērna tēvs, ir Polijas valstspiederīgā, kas dzīvo Vācijā. Tiesvedības procedūra attiecībā uz piekļuvi bērnam tika uzsākta, izmantojot tulku, kurš, iespējams, nebija pilnvarots strādāt tiesu iestādēs. Turklāt Jugendamt ir obstruktīva nostāja tiesvedībā par piekļuves kārtību.
