The petitioner complains about the lack of harmonisation of the Code of Civil procedures in Bulgaria with EU law, in particular the Council Directive 93/13/EEC of 5 April 1993 on unfair terms in consumer contracts and Art. 47 of the Charter of Fundamental Rights of the European Union. The petitioner, a debtor, had legal proceedings against him in the courts and was allegedly deprived of his rights of defence. He accuses private bailiffs of carrying out enforcement actions without having been duly authorised to do so. His efforts to alert the competent state institutions in Bulgaria and informing about this malpractice were unsuccessful. In the petitioner’s opinion there is no legal possibility to challenge the acts of bailiffs and there is no effective control over them in Bulgaria.
