On non-compliance with Implementing Decision (EU 2015/893) of 9 June 2015 – felling of trees infested by the Asian Longhorn Beetle in the city of Miesbach  

The petitioner claims that in several parks in the city of Miesbach there is a healthy deciduous tree stock that needs to be preserved. However, pursuant to a decision taken in November 2019 by the Bavarian State Institute for Agriculture (Bayrisches Landesanstalt für Landwirtschaft – LfL), part of the stock has to be felled, since infestation by the Asian Longhorn Beetle could not be ruled out. The petitioner objects to this with reference to Implementing Decision (EU 2015/893) of 9 June 2015. He also objects to the decision of the LfL although he has not submitted a decision of the LfL in this regard. He claims that the felling is contrary to Implementing Decision (EU 2015/893) of 9 June 2015 because it is a culturally and historically valuable tree population and Annex III provides for the possibility to make exceptions within a radius of 100m. He calls for the planned measures to be stopped for the time being.
