The petitioner states that certain areas within the Parco Montemarcello Magra Vara, established in 1995, are considered Special Areas of Conservation (SAC) (within the framework of the Natura 2000 network pursuant to Directive 92/43/EEC), and are managed by the Park Body. A regional bill threatens to abolish the Park Body and restore the spatial planning powers to the municipalities falling within its borders, thus risking exposing the rich biodiversity of the protected sites to hydrogeological risks or human activities incompatible with protecting the landscape, such as excavations in the river bed, illegal landfill sites, illegal construction, eutrophication or hydraulic works which alter the aquatic environment and its vegetation. In particular, there is an alleged risk of weakening both administrative procedures and verifying compliance with the park’s specific regulations (park plan), following the potential removal of the Park Body and the chronic shortage of national police and forester numbers. In this regard, the petitioners believe that the declassification of a Site of Community Importance, can only occur if certain legal conditions are satisfied and if the investigation stipulated in Article 9 of Directive 92/43/ECC is carried out.
