On the enforcement of airline liability under the Montreal Convention

The petitioner flew from a third country to the EU on a flight operated by a non-EU airline . The petitioner’s baggage was damaged during the flight. The airline was prepared to pay compensation amounting to EUR 150 through an air transport arbitration procedure. The justified claim, however, cannot be enforced for economic reasons, inter alia, since the involvement of a lawyer or of a collection agency is either not possible or not worth it when the amount of compensation for damage involved is modest. The petitioner is seeking an EU-wide amendment to the Convention for the Unification of Certain Rules for International Carriage by Air (Montreal Convention).
