The petitioner denounces the violation of the presumption of innocence in a criminal case brought against him by the Romanian Directorate for Investigating Organized Crime and Terrorism (DIICOT). He mainly claims that the prosecution leaked confidential information from his file to the media and discredited him by physically restraining him in public, contrary to national and European law. He argues that Directive (EU) 2016/343 on the strengthening of certain aspects of the presumption of innocence and of the right to be present at the trial in criminal proceedings has direct effect in his case because it has not yet been transposed into national law and because its provisions are unconditional, sufficiently clear and precise and confer rights upon individuals.
