The petitioner complains about refusal of the judiciary to implement the primacy of European Union law in Bulgaria. According to the petitioner, the Bulgarian legislation contains legal provisions that are contrary to Council Directive 93/13/EEC on unfair terms in consumer contracts, to Article 47 of the Charter of Fundamental Rights of the European Union and to the principle of efficiency. He alleges that there are breaches in the implementation of the Order and Enforcement procedures in Bulgaria, part of the Bulgarian Code of Civil Procedure, as a result of which many Bulgarian citizens are affected. The petitioner claims that the judiciary does not issue certain judicial acts, which makes the cases initially vicious. He also alleges that debtors` procedural rights are often violated and there is a lack of supervision over the actions of the private bailiffs.
