The petitioner points out that the Region of Liguria recently decided , to authorise the construction of a biodigester in a different location to that which had previously been selected (Boscalino, Municipality of Arcola) in the regional plan.. The new location (Saliceti) in the Municipality of Vezzano Ligure, also involves a waste treatment plant with a maximum capacity of 60 000 tonnes/year (compared to the 25 000 in the original plan).The petitioner takes the view that the Liguria Region has committed a twofold infringement in respect of the population concerned, by authorising the new project under a mere EIA (Environmental Impact Assessment) , rather than a variant of the pre-existing SEA (Strategic Environmental Assessment), and in respect of the local area, during the planning of the biodigester, which is simply too large.. The petitioner complains about the alleged infringement of EU strategic environmental assessment legislation (Directive 2001/42/EC), as regards the lack of consultation and public participation in the procedure, and of the Waste Framework Directive (Article 16, Directive 2008/98/EC) as regards the application of the principles of self-sufficiency and proximity.
