On non-compliance of Bulgarian law with Regulation 1896/2006 creating a European order for payment procedure

The petition concerns a regulation of the Bulgarian Ministry of Justice approving standard forms for Order for Payment Procedure, Application for an Order for payment procedure (art.410 of Bulgarian Code of Civil Procedure), and other papers in relation to the Order for Payment procedure. The petitioner alleges that the same regulation is in contradiction of Union law, particularly Regulation (EC) 1896/2006 for creating a European order for payment procedure and certain decisions of the European Court of Justice, which are binding upon Member States. In that regard, the petitioner calls for the European Parliament’s intervention in order to safeguard the rights of the citizens and ensure Bulgaria’s compliance with EU law.
