On deficiencies in and amendments to the Written Statement Directive (91/533/ECC)

The petitioner sees deficiencies in employee protection in the Directive 91/533/EEC on the employer's obligation to inform employees of the conditions applicable to the contract or employment relationship. Furthermore, the approach of allowing affected employees to benefit from a shifted burden of proof where there is no written statement in the sense of Article 8(1) of the Directive fails because of the different procedural traditions of the Member States. The petitioner offers concrete proposals for amendments to Directive 91/533/EEC that aim to protect employees.
