The petitioner complains about discrimination and an infringement by Italy of Regulation (EC) No 883/2004 on the coordination of social security systems. The petitioner, a Hungarian citizen resident in Italy, condemns in particular the rejection by the National Social Security Institute (INPS) of her application for payment of family allowances. The petitioner applied to the Italian authorities for authorisation to include her two daughters in her household. The local office of the INPS rejected the application on the following grounds: ‘The family member does not reside in a State with which there is a reciprocity agreement (Article 2(6a) of Law No 153 of 13 May 1988)’. According to the petitioner, this decision by the Italian authorities infringes Regulation (EC) No 883/2004 and the very law cited, Law No 153 of 1988, as the petitioner is a European citizen. European citizens have equal rights to citizens of the Member States and no discrimination can be permitted. The petitioner therefore asks the European Parliament to take action to require Italy to comply with European legislation.
