The petitioners are three of the thousands of displaced residents and owners of land property in Famagusta, which, along with other areas in Cyprus, has been occupied by Turkey since 1974. As a result, they are denied access to possession and use of their homes and properties since then.The petitioners do not challenge Protocol 10 of the terms of Cyprus’ accession to the EU in 2004, which provides in Article 1.1 for the suspension of the application of EU law in those areas in Cyprus over which the Republic of Cyprus has no effective control.On the other hand, considering the excessive length of the suspension and the indefiniteness of its future operation, the petitioners call on the EU to provide for the compensation of the displaced owners for their loss of use over the last fifteen years and in the future, for as long as the suspension is in operation.
