Andrageren klager over, at domstolene angiveligt nægter at håndhæve princippet om EU-rettens forrang, hvilket har været til skade for mange bulgarske borgere. Andrageren hævder, at der er mangler i gennemførelsen af betalingspåbudsproceduren, og hævder, at håndhævelsen af obligatoriske betalingsanmodninger i Bulgarien ikke garanterer forbrugernes rettigheder.
