On the alleged violation of Directive 93/13/EEC on unfair terms in consumer contracts by Bulgaria

The petitioner complains about the non-compliance of the Bulgarian legislation with Directive 93/13/EEC on unfair terms in consumer contracts. According to her, the Bulgarian judicial proceedings under Article 417 of the Bulgarian Code of Civil Procedure do not meet the requirements set in the Directive and are in breach of the right to an effective remedy and to a fair trial as prescribed by the Charter of Fundamental Rights.
