Podnositeljica predstavke žali se na neusklađenost bugarskog zakonodavstva s Direktivom 93/13/EEZ o nepoštenim uvjetima u potrošačkim ugovorima. Prema njoj, bugarski sudski postupak u skladu s člankom 417. bugarskog Zakona o parničnom postupku ne ispunjava zahtjeve iz Direktive te se njime krši pravo na djelotvoran pravni lijek i pošteno suđenje kako je propisano Poveljom o temeljnim pravima.
