The petitioner argues that the Maltese law on acquisition of immovable property by non-residents is discriminatory against third country nationals (TCNs), in breach of Directive 2003/109/EC. She points out that, unlike EU citizens or spouses thereof, TCNs who have been residing in Malta for more than 5 years and hold a long-term residence permit are unable to purchase immovable property.
