The petitioner claims that the Romanian legislation on public passenger transport services by road infringes EU legislation because, among other things, it allows public bodies to grant exclusive transport rights to operators of their choice without signing public services contracts and without establishing clear, objective and non-discriminatory award criteria. In addition, Romanian legislation allegedly does not provide for effective remedies and allows for the transport licence to be issued despite it being challenged in court, in breach of Council Directive 89/665/EEC.
