The petitioner describes the problems he had after his insolvency and his inability to pay back his consumer loan to the bank and subsequent unfair actions of the private bailiffs. He alleges that Bulgarian courts are not applying the Regulation No 805/2004 creating a European Enforcement Order for uncontested claims, the Regulation No 1896/2006 creating a European order for payment procedure, as well as Directive 93/13/EEC on unfair terms in consumer. Therefore, the petitioner calls for action by the European Parliament regarding the potential breaches following Payment Order Procedure and Enforcement Procedure under Part 5 of the Bulgarian Code of Civil Procedure. He also requests for setting up a mechanism to compensate for the harm suffered by debtors as well as the hundreds of thousands of small and medium-sized enterprises affected by alleged illegally conducted procedures.
