The petitioner calls on the EU to work within the WTO towards the recognition that weak or non-existent environmental regulation in some countries represents a genuine, meaningful and deliberate “actionable subsidy”. Such a recognition would allow other countries with stronger environmental regulation to impose duties on the exports of polluting countries, in order to counterbalance the competitive disadvantage to their domestic industries of adhering to higher environmental standards.
