On alleged infringement of European law by a court in Germany

The petitioner draws attention to the alleged infringement of EU law by a German court in divorce proceedings, in a case which is the subject of other proceedings before a court in Poland. In her application for divorce, the petitioner also requested that the matter of parental responsibility be determined with regard to her daughter. In the petitioner’s view, according to the provisions of German and European law, the case should be suspended ex officio if the same request between the same parties is already pending. However, the German court has not suspended proceedings and has tried to look into the case.
