Podnositelj predstavke žali se na Direktivu 92/83/EEZ o usklađivanju struktura trošarina na alkohol i alkoholna pića, za koju smatra da je pretjerano opsežna. Smatra da, na primjer, vlasnici uređaja za destilaciju s kapacitetom manjim od 2 litre već plaćaju poreze pri kupnji alkohola koji se koristi za maceraciju.
