On private bailiffs and alleged breaches in application of the law in the enforcement procedure

The petitioner complains about private bailiffs in Bulgaria who in his opinion do not comply with the provisions of Bulgarian and European legislation, violate the rights of the debtors and do not comply with judicial decisions. He points to the lack of effective control of their actions by the internal institutions, which should by law be the responsibility of the Chamber of Private Bailiffs and the Inspectorate of the Ministry of Justice. In his case, the wrongdoings of the bailiffs consisted of blocking his all bank accounts, to recover the sum claimed from the bank accounts on a number of occasions, to retain the amount recovered from the bank accounts. He had to reimburse the overpayment and his bank accounts were preserved for months, although the enforcement proceedings have been brought to an end and the amounts recovered and transferred to the creditor.
