Lūgumraksta iesniedzējs sūdzas par to, ka viņam kā Beļģijas pilsonim, kurš nav Portugāles rezidents, tika piemērots 28 % kapitāla pieauguma nodoklis, savukārt Portugāles rezidentiem tiek piemērots tikai 14 % nodoklis. Viņš uzskata, ka šāda atšķirīga attieksme ir diskriminējoša.
