Andrageren klager over, at han som belgisk statsborger, der ikke har bopæl i Portugal, blev pålagt en skat på 28 % på sine kapitalgevinster, mens personer bosat i Portugal kun afkræves 14 %. Han anser denne forskelsbehandling for at være diskriminerende.
