On the misapplication of EU legislation on public procurement in Romania

The petitioner complains that Directive 2014/24/EU on public procurement has been wrongly implemented into Romanian legislation and is unfairly interpreted by the Romanian authorities. According to the petitioner, the current legal framework unjustly prevents contractors from updating public procurement contracts to reflect unexpected cost variations that occur in the real economy, such as the increase of prices or indirect costs or changes to the minimum salary imposed by subsequent legislation. The petitioner argues that this situation causes contractors to invest their own money, work without a profit or even go bankrupt.
