The petitioner, a German citizen, challenges the refusal of the Spanish authorities to issue a residence permit for his South African wife on the grounds that the marriage, celebrated 8 years ago in South Africa, has not been registered in Germany. He argues that this registration is not required under EU rules and that it would be a costly process and take at least 3 years to complete.
