The petitioner argues that under the new Ecodesign Regulation (1253/2014), old ventilation units also used in coal-fired power plants must be replaced by new ones. However, the new units available on the market are much larger than the old ones due to improved performance, which means that it is not possible to easily swap old for new. But the units he has invented would fit and would also consume 70-90% less electricity. However, his unit does not conform to the Regulation because it does not achieve the required fan performance. In the interests of climate protection, the petitioner calls for the Ecodesign Regulation to be amended so that a new appliance may be installed even if it fails to achieve the requisite fan performance, with the unit manufacturer having to prove that the new appliance can achieve an electricity saving of at least 70%.
