The petitioner feels discriminated against and punished, as people without children in Germany are penalised by having to pay higher care insurance contributions than people with children. He suffers from a genetic defect, as a result of which he is sterile. Under Article 21 of the Charter of Fundamental Rights, people should not be discriminated against on the basis of their genetic characteristics. He calls for the abolition of higher care insurance contributions for people without children who are sterile as a result of genetic defects rendering them unable to have children.
