O peticionário afirma que as alterações ao Código da Estrada italiano relativas à circulação de veículos estrangeiros em Itália (artigo 93.º) são incompatíveis com as disposições do Tratado de Lisboa sobre a livre circulação de pessoas (artigos 21.º, n.º 1, e 45.º, n.º 1), o direito de estabelecimento (artigos 49.º a 55.º) e a liberdade de prestação de serviços (artigos 56.º a 62.º) do TFUE. Alega igualmente que o artigo em questão é inconstitucional.
