Andrageren bestilte en LCD-skærm fra onlineindkøbsplatform i god tro. Efter at have konstateret, at denne LCD-skærm var forfalsket, bad en nonprofitorganisation, der er specialiseret i bekæmpelse af vareforfalskning, på grundlag af den nævnte lovgivning ham om at betale omkostningerne i forbindelse med bortskaffelsen. Andrageren henviser til forordning (EU) nr. 608/2013 og navnlig betragtning 24, som han mener er i strid med hans rettigheder som europæisk forbruger i henhold til artikel 38 i EU's charter om grundlæggende rettigheder.
